		<description>If you could, please explain how the accident occurred.  I assume that you do not have collision coverage on your own vehicle which is going to be a problem for you.  

If you have an agent, contact them.  They will report the loss to the other insurance company, and they will assist you in the claims handling process.  

If you do not have an agent, call the third party insurer directly, and file a claim.  Your insurance company will not pursue the claim for you.  The claims department handles claims that you have coverage for only. 

Let the adjuster know that you were injured.  Have you gone to the ER or doctor?  

The adjuster will complete a full liabiltiy investigation.  The police report will aid in the investigation and not be use solely to determine liability.  

North Carolina follows a pure contributory negligence system.  With this system, if two or more people are in an accident, the damaged person is only able to recover for his or her injuries and damages if he or she did not contribute to the accident in any way, even if it was only a very slight factor.  This is a very harsh rule, but it is what it is.  You may be barred from any recovery.</description>
