Each state law is different and each court has its local rules. Some states they will not seal or expunge the record if they believe they had a good reason for the arrest and cse. In other states, you can have any arrest that did not result in a conviction sealed. One safe rule is that if the court does not require a hearing on the matter in your jurisdiction, then you probably do not need an attorney if you don't mind doing the paperwork yourself. Also, I am not aware of any state that denies such a request with prejudice. Meaning, if you are unsuccessful on your first attempt, you or an attorney can try again. What state and county?
