My dad was rear ended and now has permanent injuries. Should he contact an attorney and sue. He has soft tissue damage in his back and neck. The insurance company has not offered any money for pain and suffering. They are just paying his medical bills.
The accident happened in KS.
He has been diagnosed with perm. injuries, but will continue treatment.
Since KS is a no fault state our insurance companies pays the bills. The doctor has sent him to go have a MRI done. Also if they do offer them what is the usually and customary amount?

You will need a lawyer to get a judgment for pain and suffering.

Soft tissue injuries are not considered permanent injuries. The insurance company may offer him something but not until he is finished with any medical care he is receiving

What state did this accident occur in? He may not be tort eligible. Why doesn’t your father contact the adjuster and find out what the threshold requirements are in your state. If he is tort eligible, he is entitled to some monetary compensation. However, the settlement will not be considered until he has stopped treating. If he alleges permanency, he needs to prove it with medical documentation. The adjuster will likely ask him to attend an Independent Medical Examination for a second opinion.
Also, if the meds are being paid perhaps the total meds have exceeded the at fault party’s policy limits. If that is the case, the adjuster should notify him. Your father should then file an Underinsured Motorist Claim.
