If you can afford to hire a lawyer, you shouldn’t be getting a public defender. But in any case, if you are pleading not guilty, hire a real lawyer. If you just plan to plead out, save your money and use the public defender.
If you can afford to hire a lawyer, I doubt the judge will give you a public defender, but you can ask the judge. For a DUI, its a total waste of money anyway.
If you can afford a laywer, you do not get the option of a public defender
You should plead guilty as you deserve to be punished. You should spend time in jail for your stupidity.
You don’t get a choice.
Either way, you will need an attorney. You won’t be allowed to defend yourself. If you request a public defender, you will have to supply a financial statement showing that you can not afford to pay for your own attorney.
I agree with CGIV76. This financial statement aLso covers property you own that could be sold to pay your own attorney. Getting a Public Defender isn’t as easy as it sounds in the Miranda rights.
