Um, the Statute of Limitations may have run out. There is a certain time period that a person has to pursure legal action and damages. I would call an ask the attorney hot line or get an opinion from legal counsel to find out for sure. Different states have different laws.
Also, call the insurance company and find out what they have to say. If you can get a copy of their report as well as the police report, that will help. It will have everything documented with times and dates.
Did the guy file a claim with the insurance company? get as much info as you can and try and get legal advice.
If you are short on cash, try the local college that offers law classes. The professor may be able to help you or direct you in the right direction. The class may even be able to tell you something.

The statute of limitations in New York for personal injury claims is 3 years. They guy is will within the time period. However, if you had insurance, your insurance company takes over handling the lawsuit for you. You shouldn’t have to do much of anything. But I wouldn’t worry about doing anything. Mostly these things are settled prior to trial and chances are you won’t even know what’s going on. Your insurance company was obligated to inform you of the suit and will contact you when, or if, your assistance is needed.
