Last night, my boyfriend was arrested for DWI. His charges are DWI, reckless driving, open container, and indicated impairment. He was speeding, that was the reckless driving..and he had two beers with a blood alcohol level of 2.1. He was taken to jail last night and got a bail bondsman to release him this morning. I want to know what the judge will most likely decide and if he’s going to go to jail. What type of lawyer should he get? I’m really worried =(
This all happened in Rio Rancho, NM.

the best thing to do would be to get with the prosecuting attorney and tell him you will plea guilty to dui if they dismiss the other charges. i dont know what state your in but speeding unless it was way over the limit really wont be reckless driving. careless maybe but not reckless. having a BAC of .21 is WAY up there though so the judge will probly hammer him because that is what he was when he was driving.
Blood Alcohol .21??? He had a lot more than 2 beers. It will depend on if he has been arrested before for DWI, the jugde’s mood, the DA’s mood and his lawyer.
For a first offense, loss of driving privledges, community service, DWI school, probation……
If the judge or DA are in a bad mood…he could get jail time.
He needs a criminal lawyer.
more lenient down there then around here. still, it’s standard these days: night in jail, done. now looking at license suspension, mandatory AA, mandatory drug and alcohol class (costs a lot), and community service. maybe drivers ed.
Exteme DWI along with the other charges… probably a minimum of 10 days in jail, fines into the four digit variety, drug and alcohol classes, a suspended license, and when he does get his license back he’ll probably have to install on of those breath car starter things. Not to mention his car will probably remain impounded for the next 30 days (several hundred dollar bill there) and insurance out the ****.
.21 is more like 12+ beers. **** to break that to you.
He probably won’t go to jail if it’s his first offense. But he will face heavy fines, probation, a suspended license and treatment classes. He should give criminal defense attorney that specializes in DWIs.
do you really want to be with a dic-khead like him?
