My son was in a car accident a few months ago. He is seeing a chiropractor who is getting paid from Med Pay through the insurance company of the car he was riding in( he was a passenger). However, the other insurance company of the car who hit them has accepted liability and after my son is all done with medical treatments will then make an offer. The problem is, the chiropractor is referring him out to a orthopedist. I consulted with an attorney who told me that doctors will not accept a lein for payment unless there is an attorney representing the injured party. My understanding of a lein is that the treating doctors or parties present this to the at fault insurance company for payment before my son would recieve his settle ment, so that they would be assured payment. Why would I need to have an attorney for them to treat him?     They do have an obligation to provide treatment for life-threatening conditions regardless of ability to pay. In this case, the condition is not life threatening. They want to ensure that you or your son don’t come into a windfall settlement and leave them hanging and is all quite normal. Your own attorney will confirm this.

    The truth is that insurance companies lie; they will never make a realistic offer until you have an attorney ready and willing to try the case/

    If the doctor of choice refers your son to another doctor – the doctor is responsible for going to the insurance company to get the authorization.
